The Modern-Day Range War: SCOTUS to Consider Corner Crossing Appeal
The Supreme Court of the US (“SCOTUS”) has granted the request of lawyers for the landowner to consider a motion for certioari (“Cert”) probably in October. A Cert motion is a legal procedure to request a higher court to review a lower court’s decision to ensure legal correctness, on very important legal issues having national significance. Last year the Federal Court of Appeals in Denver upheld the 2023 decision of the Federal District Court in Wyoming. These 2 decisions side with hunters who assert the right to corner cross without physically touching private land. As such, in these decisions the courts ruled against the property rights of the landowner who argues that corner crossing is trespassing. Since this case has substantial national significance, I expect that SCOTUS will grant the Cert motion of the landowner and take the case for argument with a decision in 2026.
